1. Data controller
For the purposes of the German Federal Data Protection Act (“BDSG”), PowerBar Europe GmbH, Zielstattstraße 42, 81379 Munich (hereinafter “PowerBar” or “we”), as the operator of the website www.PowerBar.eu, is the data controller with regard to the personal data of the website users (hereinafter: “you”).
PowerBar Europe GmbH takes the protection of your personal data very seriously. We collect, process and use your personal data in compliance with the content of these data protection provisions and the applicable German data protection legislation, in particular the German Federal Data Protection Act (“BDSG”) and the German Telemedia Act (“TMG”).
We provide a comprehensive and detailed explanation below about the data we collect during your visit to our site and how we use this information, so that you will feel totally secure and at ease when visiting our website. We would therefore ask you to read the following information carefully.
2. Personal data
For the purposes of this Privacy Statement, personal data refer to particulars about the personal or material circumstances of an identified or identifiable natural person. This includes information such as your name, your address, your email address, your telephone number and your date of birth. Statistical information that cannot be linked either directly or indirectly to you, for example, a preference for individual pages on our website or the number of users of a given page, are not personal data.
3. Collecting utilization data
We do not collect personal data if you are using our website simply for information purposes, that is, if you are not logging in, registering or providing us with other information in order to use the website, with the exception of the information that is transmitted by your browser to enable your visit to our website. This data set consists of the following:
the web page from which the website was requested,
the name of the website,
the date and time of the retrieval,
the transferred volume of data,
the access status (file transfer, file not found),
a description of the type of browser used,
the IP address of the requesting computer without the final three digits,
operating system and the user interface,
language and version of browser software.
We use this information to improve the quality of our website and in particular to ensure that our website is made available to you as efficiently and in the most interesting manner possible. This information is stored in accordance with the German Telemedia Act (TMG) in an anonymised form. The creation of personal user profiles is therefore excluded.
We use so-called cookies in some areas of our website, for example, in order to recognise user preferences and to optimize our website accordingly. Session cookies (also called transient cookies) are automatically deleted when you close your browser. Persistent cookies are automatically deleted after a pre-defined period that can vary depending on the cookie. You may delete the cookies at any time in the security settings of your browser.

Flash cookies used are not collected through your browser but through your Flash plug-in. These store the required information regardless of the browser you use and have no automatic expiry date. 5. Web tracking
We create pseudonymised user profiles using Google Analytics in order to provide a needs-based website design. Google Analytics uses “cookies” which are text files placed on your computer to help the website analyse how users use the site. The information generated by cookies about your use of this website will generally be transmitted to and stored on a Google server in the USA. As we have activated IP anonymization on this website, your IP address will be truncated in advance within the territory of the Member States of the European Union or the other members of the European Economic Area. Only in exceptional cases will the full IP address be first transmitted to a Google server in the USA and truncated there. Google will use this information on our behalf for the purpose of evaluating your use of the website, for compiling reports on website activity and for providing other services related to website activity and Internet usage.
The IP address transmitted by your browser within the scope of Google Analytics will not be associated with any other data held by Google. You may prevent the storage of cookies by selecting the relevant setting in your browser; however, we would like to point out that if you do this you may not be able to avail of the full functionality of this website. There are a number of ways of preventing the storage of cookies:
a) you may set an opt-out cookie that will instruct Google not to store or use your information for the purpose of web analysis. 6.1 You may subscribe to our free newsletter through our website. The newsletter provides information on current offers, interesting nutrition tips and other special features. We use the so-called double-opt-in procedure for subscribing to our newsletter. This means that, once you have sent us your email address, we send you a confirmation email to that address in which we ask you to confirm that you have requested subscription to the newsletter. If you do not confirm this within 24 hours, your subscription request will automatically be deleted. If you confirm the request to subscribe to our newsletter, we will store your email address until such time as you unsubscribe from it. We store the email address for the sole purpose of sending you the newsletter. Furthermore, we store your IP address when you register and send confirmation, and also the relevant times, in order to prevent the misuse of your personal data.
6.2 We require your email address for your subscription. You may notify us of your name but you do not have to. If you do notify us of your name it will be used only for the purpose of personalising the newsletter.
6.3 If required, we use special third-party providers for disseminating our newsletter, which requires the transmission of user data to these third-party providers. This may also involve the transmission of user data to the USA.
6.4 You may withdraw your consent to the transmission of the newsletter at any time. You may declare your intention to withdraw by clicking the link provided for this purpose in each newsletter, by sending an email to friends@PowerBar.de or by notifying the contact listed in the Imprint. Your email address will then be deleted from the distribution system without delay.
6.5 Insofar as you have registered for the newsletter, in doing so you have submitted the following declaration of consent:
I would like to receive by email the newsletter of PowerBar Europe GmbH containing information on their offers from the areas of energy & hydration (energy gels, energy bars, isotonic sports drinks, electrolyte sports drinks), recovery (protein bars, protein powders, protein drinks) and nutrition supplements. My data shall under no circumstances be disclosed to third parties. I may withdraw my consent at any time by sending an email to friends@PowerBar.de. In addition, each email contains a link for cancelling further information.
6.6 We wish to point out that we evaluate your user behaviour when we are distributing the newsletter. For this evaluation, the emails dispatched contain so-called web beacons, also referred to as tracking pixels. These are single pixel graphic images that link to our website, thereby enabling us to evaluate your user behaviour. The evaluation is carried out by collecting the data listed at item 3 above and using web beacons that are assigned to your email address and linked with its own ID. The data are only collected anonymously, this means that the IDs will not be linked to your personal data, therefore excluding the direct identifiability of the person. The information collected in this manner is stored by the newsletter provider on its server in the USA. You may withdraw from this tracking at any time by clicking the special link provided in all emails or by notifying us through the contact channels listed under item 11. Tracking is also not possible if you have disabled the display of images in your email program as standard. In this case, however, the newsletter will not display fully and you may not be able to avail of the full functionality. The above-mentioned tracking does work if you display images manually.
7. Social networks
7.1 Use of social media plug-ins
7.1.1 We use the following social media plug-ins: Facebook, Google+, Twitter, WhatsApp. We use the so-called 2-click approach. This means that when you visit our website, no personal data will be transferred initially to the providers of these plug-ins. You will recognise the plug-in provider by its initial letter marking on the greyed-out box. Personal data will only be transmitted if you click on one of the plug-ins: If a plug-in is activated, data will automatically be transmitted to the relevant plug-in provider and stored there (stored in the USA in the case of US American providers). We have no influence over the collected data or the data processing procedures nor have we knowledge of the full extent of the data collection, its purpose or the storage periods. Given that the plug-in providers collect data in particular through cookies, we recommend that you delete all cookies through the security settings in your browser before clicking any of the greyed-out boxes.
7.1.2 When you activate a plug-in, the plug-in provider receives the information that you have accessed the specific sub-page in our website. In addition, the data mentioned at item 3 of this statement will be transmitted. This is the case regardless of whether you have an account with the plug-in provider and are logged in or not. When you are logged in with the plug-in provider this information will be included in your account. If you touch the activated button and for example link to a page, the plug-in provider will also store this information in your user account. You have to log out before activating the button if you do not wish to have this information included in your profile with the plug-in provider.
7.1.3 The plug-in provider stores this information as usage profiles and uses it for the purposes of advertising, market research and/or the needs-based design of its website. Such an evaluation is used in particular (also for users not logged in) to create needs-based advertising and to inform other users in the social network about your activities on our website. You have the right to object to the creation of this user profile, however, you have to contact the plug-in provider directly in order to exercise that right.

7.2 Incorporation of third-party services
7.2.1 We have incorporated YouTube video clips into our website that are stored on http://www.YouTube.com and can be played directly from our website. They are all incorporated in the “enhanced data protection mode”, that means that no information about you as a user will be transmitted to YouTube as long as you do not play the videos. However, once you play a video, the data listed at item 3 will be transmitted. We have no influence over this data transfer.
8. Data transfer to third parties
At times, we use the services of external service providers for processing your data. These service providers have been carefully selected by us and commissioned in writing. They are bound by our instructions and we monitor them regularly. The service providers have access to your personal data only to the extent and for the duration that is required to provide the service. The service providers will not transmit this information to third parties. In the event that these service providers are based in the USA, we shall notify you of this in relation to their specific data processing functions for the website. The data processing will also be carried out in accordance with any applicable legislation.
9. Data security
We implement technical and organisational security measures in order to protect your data as comprehensively as possible from unauthorised access. In addition to safeguarding our operating environment we also use, for example, encryption procedures in some areas. You will recognise this if the lock symbol in the status bar of your browser is closed and the address line begins with “https”. We continuously improve and adapt our security measures to reflect the state of the art.
10. Your rights as a user
You have the right as a user to request information about the data stored by us about you and about the origin of such data, the recipients or categories of recipient to whom the information was transmitted and the purpose for which this information was stored. In addition, you may have incorrect data corrected or have data deleted the storage of which is prohibited or no longer required. If you have given consent for your data to be stored you may withdraw this consent at any time.
